Agreement to Terms

These Terms and Conditions (“Terms”) govern your access to and use of stoveshield.com (the “Site”) and the purchase of products through the Site. The Site is owned and operated by Stove Innovations LLC (“Company,” “we,” “us,” or “our”).

BY CREATING AN ACCOUNT, PLACING AN ORDER, OR OTHERWISE USING THIS SITE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THIS SITE OR PURCHASE PRODUCTS FROM US.

Your placement of an order constitutes your acceptance of these Terms at the time of purchase.

Eligibility

You must be at least 18 years of age to use this Site or make purchases. By using this Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

Privacy

Intellectual Property

All content published and made available on the Site is the property of Stove Innovations LLC and its licensors. This includes, but is not limited to, images, text, logos, graphics, documents, downloadable files, product designs, and all other content that contributes to the composition of the Site. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from this Site without our prior written consent.

Accounts

When you create an account on our Site, you agree to the following:

  1. You are solely responsible for maintaining the confidentiality and security of your account credentials, including your password;
  2. You are responsible for all activity that occurs under your account;
  3. All personal information you provide is accurate, current, and complete, and you will promptly update such information if it changes; and
  4. You will notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your account if you violate these Terms or use the Site in any manner we deem inappropriate or unlawful.

User Conduct

Through continued engagement with this Site, you agree to refrain from the following:

  1. Use the Services for any unlawful purpose
  1. Transmit viruses, malware, or harmful code
  2. Interfere with the Services or other users
  3. Attempt to gain unauthorized access
  4. Scrape, crawl, or data-mine the Site without permission
  5. Impersonate any person or entity

We may remove content, or terminate access, for any conduct determined, at our sole discretion, to violate these Terms, is deemed harmful, or is believed to be potentially harmful.

Product availability is subject to change without notice. We reserve the right to discontinue any product at any time.

We make reasonable efforts to ensure that product descriptions, images, and specifications are accurate. However, we do not warrant that product descriptions, images, pricing, or other content on the Site are accurate, complete, reliable, current, or error-free. Colors and dimensions may vary slightly from what appears on your screen.

Your submission of an order is an offer to purchase. We reserve the right to accept or reject any order, in whole or in part, for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraud. If we cancel your order after payment has been processed, we will issue a full refund to your original payment method.

Intellectual Property

All content on the Site, such as text, graphics, logos, and software code, is owned and protected by US copyright, trademark, and other laws.

Through use of the Site, a grant of a limited, non-exclusive, non-transferable, revocable license is provided to access, and use, the Services for personal, non-commercial purposes only.

You retain ownership of any content you post, which may be characterized as “User Content”, but by posting such content, you grant the Site a worldwide, royalty-free, perpetual, irrevocable, license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with operating, promoting, and improving the Services.

You acknowledge and agree that inaccurate, incomplete, outdated, or misleading User Data may result in guidance or outputs that are unreliable, inapplicable, or incorrect. We disclaim all liability for any outcomes, damages, or losses arising from or related to your submission of inaccurate or incomplete User Data, including any reliance on guidance generated from such data.

Informational Purposes Only

The Site may provide guidance and recommendations that are meant to provide products with accurate fitment and purpose.

Any guidance offered by the Site is general in nature and based on User Data provided to the Site. As such, any guidance and recommendations from the Site is meant to be informational and in no way guarantees fitment and purpose with your products.

The Site may contain links to third-party websites or services. We are not responsible for their content, privacy practices, or availability. Your use of third-party services is at your own risk and governed by their terms.

Payments

All prices are listed in U.S. dollars and are subject to change without notice.  Prices do not include shipping, handling, or applicable taxes, which will be calculated and displayed at checkout.

We accept the following payment methods on our Site:

  • Credit Card;
  • PayPal; and
  • Debit.

By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the full order amount (including shipping, taxes, and any other applicable fees) to that payment method.

If we reasonably believe that a payment transaction violates applicable law or these Terms, we reserve the right to cancel or reverse the transaction.

Shipping and Delivery

Products will be delivered through one of the following methods:

  • USPS (approximately 3 to 8 business days shipping time)
  • UPS Ground (approximately 2-5 business day shipping time).
  • UPS AIR (approximately 2 business days shipping time)
  • International Shipping (approximately 8-20 business days shipping time).

Shipping times are estimates only, do not include weekends or holidays, and may vary due to carrier delays or other circumstances beyond our control.

Shipping charges are in addition to the product price and will be displayed at checkout prior to order completion.

In addition to shipping times, there is a 0-2 business day fulfillment time on all orders.

If you order products for delivery outside the United States, your purchase may be subject to import duties, taxes, and customs fees imposed by the destination country. You are solely responsible for paying all such charges. We recommend contacting your local customs office before placing an international order. We are not responsible for delays caused by customs processing.

You are responsible for providing a complete and accurate delivery address, including the recipient’s name. We are not liable for non-delivery, delayed delivery, or delivery to the wrong address or person resulting from inaccurate or incomplete address information you provide.

Returns, Refunds, and Exchanges

Before requesting a refund, please contact us at service@stoveshield.com. We want to help resolve any issue you may have with your order.

To be eligible for a return:

  • The return request must be submitted within 30 days of your order date;
  • Items must be unused and show no visible signs of wear or use; and
  • You must provide your order number and reason for the return.

To initiate a return or exchange:

  1. Contact us at service@stoveshield.com with your order number and reason for return.
  2. We may request a photo of the product on your cooktop for review.
  3. Upon approval, ship the item to:

Once we receive and inspect your return, we will process your refund within 5 business days. The credit will be applied to your original payment method. Please allow additional time for your financial institution to post the credit.

Shipping paid on the order by the customer is non-refundable. Return shipping costs are the customer’s responsibility.

Import duties, customs fees, or other charges paid on international orders are non-refundable.

Defective or Damaged Products

We will refund or replace any product that arrives defective or damaged in shipping, provided you notify us within 30 days of your order date. Photographic evidence of the defect or damage is required. This policy does not cover dissatisfaction with product fit or cosmetic appearance consistent with the product’s intended design.

Missing or Incorrect Items

Claims for missing or incorrect items must be submitted within 30 days of your order date.

Disclaimer of Warranties

THE SITE AND ALL PRODUCTS SOLD THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STOVE INNOVATIONS LLC, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
  • LOSS OF PROFITS, REVENUE, DATA, OR USE;
  • COST OF SUBSTITUTE PRODUCTS OR SERVICES; OR
  • ANY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR ANY PRODUCTS PURCHASED THROUGH THE SITE,

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITE OR ANY PRODUCT EXCEED THE AMOUNT YOU PAID TO US FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow exclusion of implied warranties or limitation of liability, so some limitations may not apply.

Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Stove Innovations LLC, its directors, officers, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Site;
  • Your violation of these Terms;
  • Your violation of any applicable law or regulation; or
  • Your violation of any third party’s rights.

Governing Law and Jurisdiction

These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

You consent to the exclusive jurisdiction and venue of the state and federal courts located in Duval County, Florida.

Class Action Waiver: You agree that disputes will be resolved only on an individual basis and not as part of any class, representative, or private attorney general action.

Consumer Protection Laws

Where any consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms will not limit your legal rights and remedies under that legislation. These Terms will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and such legislation, the mandatory provisions of the legislation will apply.

Prohibited Conduct

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable law or regulation;
  • Attempt to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks connected to the Site;
  • Use any automated means (including bots, scrapers, or spiders) to access or collect data from the Site;
  • Interfere with or disrupt the operation of the Site or the servers or networks used to make the Site available;
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity;
  • Transmit any viruses, malware, or other harmful code; or
  • Engage in any conduct that restricts or inhibits any other user from using or enjoying the Site.

We reserve the right to terminate your access to the Site for any violation of these prohibitions.

Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, supply chain disruptions, government actions, pandemics, epidemics, power failures, internet or telecommunications failures, or carrier delays.

Electronic Communications

By using the Site or providing your email address, you consent to receive electronic communications from us, including order confirmations, shipping notifications, and other transactional messages. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such finding shall not affect the validity of the remaining provisions, which shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties’ original intent.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or policies published on the Site, constitute the entire agreement between you and Stove Innovations LLC regarding your use of the Site and purchase of products. These Terms supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written, relating to the subject matter of the referenced agreements.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Stove Innovations, LLC.

Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms without restriction. These Terms shall be binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.

Changes

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email (if you have provided one) or by posting a notice on the Site prior to the effective date of the changes. Your continued use of the Site following the posting of revised Terms constitutes your acceptance of such changes. We encourage you to review these Terms periodically.
